EWS कोटा- स्कूलों में एडमिशन को लेकर हाई कोर्ट का आदेश, आय सीमा को बढ़ाकर किया 5 लाख
DELHI HIGH COURT ON EWS: दिल्ली हाई कोर्ट ने आर्थिक रूप से कमजोर वर्ग (EWS ) कोटा के अंतर्गत राष्ट्रीय राजधानी दिल्ली के स्कूलों में दाखिले के लिए तय आय सीमा को सालाना एक लाख रुपये से बढ़ाकर पांच लाख सालाना करने का आदेश जारी किया है। दिल्ली हाइ कोर्ट ( DELHI HIGH COURT) ने सरकार को इस मामले में संशोधन करने का आदेश भी दिया है। कोर्ट का कहना है कि जब तक इस कानून में संशोधन नहीं हो जाता तबतक इस फैसले को ही आय सीमा के रूप में देखा जाए। अदालत के इस फैसले के बाद दिल्ली के स्कूलों में आर्थिक रूप से कमजोर वर्ग की श्रेणी में दाखिले के लिए सालाना 5 लाख रुपये की सीमा ही मानी जाएगी।

आपको बता दें कि मौजूदा नियम के मुताबिक, इडब्ल्यूएस आरक्षण के मातहत जिनका नामांकन होना है उसके माता-पिता की कुल सालाना आय 1लाख रुपये से कम होना चाहिए और साथ ही साथ पिछले तीन वर्षों से दिल्ली में निवास का भी शर्त है। इन नियमों के अंतर्गत आने वालों को ही ईडब्ल्यूएस आरक्षण (EWS RESERVATION) का पात्र माना जाएगा। कोर्ट ने इस ओर ध्यान देते हुए कहा कि दिल्ली में एक मजदूर जिसका वेतन काफी कम है फिर भी उसके बच्चे इस आरक्षण का लाभ नहीं ले पा रहे हैं।

आपको बता दें कि हाई कोर्ट का यह फैसला उस मामले में आया जिसमें एक व्यक्ति ने जन्म तथा आय प्रमाण-पत्र की हेराफेरी कर अपने बच्चे का दाखिला ईडब्ल्यूएस (EWS) श्रेणी में कराने में सफल रहा। मामले के खुलासे पर जब स्कूल ने उसका नामांकन को लेकर प्रश्न जारी किया तो लड़के की ओर से इस बाबत याचिका दायर की गई। जिसे माननीय अदालत ने खारिज करते हुए फैसला दिया कि चूकि इस मामले में उस बच्चे की कोई गलती नहीं है इसलिए वह उस स्कूल में सामान्य श्रेणी में अपनी पढ़ाई जारी रख सकता है । लेकिन कागजात के हेराफेरी के लिए बच्चे के पिता पर 10 लाख का जुर्माना भी लगाया। अदालत ने इस फैसले को विस्तार देते हुए आय सीमा को 5 लाख कर दिया और सरकार को नए नियम बनाने का निर्देश भी जारी किया।
