तटरक्षक बल में महिला अधिकारियों के स्थाई कमीशन को लेकर सुप्रीम कोर्ट की केंद्र सरकार को फटकार
बीते सोमवार को सुप्रीम कोर्ट ने तटरक्षक बल में महिला शॉर्ट सर्विस अपॉइंटमेंट से जुड़े एक केस की सुनवाई के दौरान केंद्र सरकार द्वारा तटरक्षक बल में महिला को स्थायी कमीशन से बाहर रखने के फैसले की आलोचना की और साथ ही भारत के मुख्य न्यायाधीश (CJI) डी वाई चंद्रचूड़, न्यायमूर्ति जे बी पारदीवाला और न्यायमूर्ति मनोज मिश्रा जी ने कहा कि जब भारतीय सरकार सेना – नौसेना में महिलाओं को कमीशन दे रही है तो तटरक्षक बल इसमें पीछे क्यूं रहे ?
उन्होंने कहा कि आप नारी शक्ति की बात करते है तो उसे यहाँ भी दिखाइए| बताइए कि फिर तटरक्षक बल महिला अधिकारी लाइन से बहार क्यों रहे ? क्या आपने बबिता पुनिया केस से जुड़ा फैसला नहीं पढ़ा है, जिसमें महिला शॉर्ट सर्विस कमीशन अधिकारी और पुरूष अधिकारी को समान स्थाई कमीशन का हकदार माना गया है। इस पर सॉलिसिटर जनरल (एएसजी) विक्रमजीत बनर्जी ने सरकार का पक्ष रखते हुए कहा कि तटरक्षक बल सेना – नौ-सेना के मुकाबले बहुत अलग काम करते है। जिसपर कोर्ट ने सवाल उठाते हुए पूछा कि तट-रक्षक बल में महिला अधिकारी को कमीशन क्यों नहीं दिया जा सकता, साथ ही कोर्ट ने यह भी कहा कि नौसेना में महिलाएं है तो कोस्ट गॉर्ड में ऐसा क्या खास है? कोर्ट ने यह भी कहा कि वो समय चला गया जब हम बोलते थे कि महिलाएं तट-रक्षक नहीं बन सकती। जब महिलाएं सीमा की रक्षा कर सकती है तो तटों की क्यों नहीं?
आपको बता दें कि बबीता पुनिया केस 2020 से जुड़े अपने फैसले में अदालत ने माना था कि समाज अपनी परंपरागत सोच को मानता आ रहा है कि महिलाएं पुरुष के मुकाबले शारीरिक रूप से कमजोर होती है। लेकिन अपने फैसले में कोर्ट ने यह भी साफ हिदायत दी थी कि शॉर्ट सर्विस कमीशन में महिला पुरुष के मुकाबले समान हक रखती है। इन्हें भी स्थायी कमीशन में शामिल होने का पूरा अधिकार है।
